GeeksPerHour Terms & Conditions – Read Before You Join!

GeeksPerHour.com is a podium to ease the interaction between Freelancers and Service Users/ Consumers. This Agreement contains the terms and conditions that conduct the policy to access and participate in and utilization of GeeksPerHour.com. When leaf through, accessing the features of GeeksPerHour.com, and/ or participating in the offered services, Users assent to be bound by the terms and conditions herein as well as policies that may be uploaded from time to time along with any modifications, changes, and amendments thereof.

1. Roles and Responsibilities

(a)Consumer(s) means Person(s) who access or aid services of Freelancers inter alia by posting/ uploading project requirements via GeeksPerHour.com;

(b) GeeksPerHour.com means the GeeksPerHour.com website including the advertisements of project requirements, e-mail and chat functions, internet links, and all content uploaded, available and functional through the domain and sub-domains of GeeksPerHour.com at www.geeksperhour.com;

(c) Freelancer(s) means Person(s) who apply for/ indicates interest in the project requirements posted by the Consumers via GeeksPerHour.com and provide services to Consumers in compliance with such project requirements.

(d) Intellectual Property includes means all patents, trademarks, service marks, logos, get up, trade names, internet domain names, right in designs, blueprints, programmers and manuals, codes, copyright (including rights in computer software), database rights and right in know-how and other intellectual property rights, in each case whether registered or unregistered and including any application for registration, and all rights or forms of protection having equivalent or similar effect anywhere in the world;

(e)Owner refers to GeeksPerHour.com , a company incorporated under the provisions of the Companies Act, 2013 and having its registered office at

(f)Person(s) means any individual as well the business represented, an association of persons, company, corporation, partnership, limited liability partnership, governmental authority, whether or not having distinct legal existence;

(g)User(s) and You includes Freelancers and Consumers and any Person that otherwise accesses/ browses through GeeksPerHour.com

2. ELIGIBILITY OF USERS

The following persons are allowed to use access and utilize the services and functionalities of GeekPerHour.com:-

(a)Any individual who is 18 years or above with a sound mind and stable is to use the services and facilities of the site.

(b)According to the Indian Contract Act, 1872 along with amendments thereof;

(c)Legal persons who have properly been incorporated/ registered as per the provisions of relevant laws in force, acting through persons/ officials who are appropriately authorized to represent and bind such legal persons.

Usage oF GeeksPerHour.com

(a)If you want to use and participate in the facilities of GeeksPerHour.com both as a Freelancer and a Consumer, you must have to create an account with GeeksPerHour.com. You will have the option of creating an account by submitting inter alia a valid email address, username, and password through the account registration page.

(b)You shall be only responsible for all the activity that occurs through your account and you shall notify the Owner of any breach of security or illegal/ unauthorized/ activity on/ via Your account.

(c)You can any time terminate the services of GeeksPerHour.com just by clicking “Deactivate Account”. Users will not be able to deactivate their accounts during the pendency of the project. Users only can deactivate the account once they have completed the work with proof.

1 Creation of Profile

Every Freelancer and Consumer has an option to create and maintain a profile by providing accurate and verified with a clear photograph. So Be You! Only verified users are allowed to use the services

You will wholly be responsible for the validity, authenticity, legitimacy, and use/ misuse of such information displayed and the Owners are not responsible for any violation and/or damages/ loss/ consequence suffered by You.

2 Applications by Freelancers

Every Freelancer is entitled to apply for/ express his/her interest in any project requirement posted on GeeksPerHour.com.  The Freelancers are prerequisite to fill up the registration form afterward a test will be conducted to check English and Technical skills. Once the Freelancer cleared the test he/she will be shortlisted for GPH-Readiness Test.

3 Selection Process

GeeksPerHour.com’s selection process is completely automated. GeekPerHour.com will not be partial at the point of selection. The deserving candidate will secure the job. Initially, Freelancers must have to deposit Rs. 5000 as security.

4 Relationship between the Freelancer and Consumer

Freelancer and Consumer cannot communicate out of the GeeksPerHour.com’s platforms. Always receive payment through GeeksPerHour.com. If Consumer offers to pay Freelancer outside the GeeksPerHour.com just diminish it and acknowledge The Owner.

5 Modifications of GeeksPerHour.com

The Owner reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Website or any part/ feature thereof without any notice and at the sole discretion of the Owner. The Owner is not liable to the Users and/ or any third parties for any loss such modification, suspension, or discontinuation of the website and the services.

4. REPRESENTATION AND OBLIGATION OF USERS

4.1 Any tests, certification, registration charges are non – refundable.

4.2 The payment of the trial package will not be paid.

4.3. Every Freelancer undertakes that he is legally qualified to perform services in his capacity as an independent service provider.

4.4. You undertake that comments/ reviews posted by You are true, genuine, and are based on the exercise of careful, prudent, and sound judgment of the experience.

4.5. No illegal or activities otherwise deemed to be unlawful will be provided directly or under the garb of fabricated project requirements and only those as posted and agreed by the User and Freelancer to be provided.

4.6. You hold and possess the requisite Intellectual Property Rights to communicate, publish, display, exchange and provide use of all the data/ information posted by You.

4.7. Users undertake not to solicit or provide services that are illegal/ unlawful/ in contravention of the laws in force, either directly or indirectly.

5. RIGHT TO USE

The Freelancers are prerequisites to fill up the registration form afterward a test will be conducted to check English and Technical skills. Once the Freelancer cleared the test he/she will be shortlisted for GPH-Readiness Test. Then you must have to create an account with GeeksPerHour.com.

6. CONSEQUENCE OF CONTRAVENTION

6.1 If freelancers are found guilty of malpractices, like spamming, foul language, unprofessional behavior, lack of accountability will result in an account ban and the security deposit will be forfeited.

6.2 The misrepresentation of GeeksPerHour.com on social media which could harm GeeksPerHour.com reputation will result in legal action.

6.3 Misrepresentation of skills is not allowed and can cause a ban on usage/access of the Site.

6.4 If a Freelancer fails to deliver the project on the deadline, it affects your profile adversely.

6.5 If you are caught for any hacking or reverse-engineering on GeeksPerHour.com website, you will be charged with illegal activities.

7. The following terms and conditions govern your access to and use of the GPH website, including any content, functionality, policy, and services offered on or through www.geeksperhour.com

Please read the Terms of Service carefully before you use the Site. To start using the Site or creating an account by clicking to accept or agree to the Terms of Service and to be bound and abide by these Terms of Service and our Privacy Policy. If you are not agreeing to these Terms of Service or the Privacy Policy, you must not access or use the Site. For more detailed policies and conditions surrounding the activity and usage on the Site, please access the designated articles herein.

  1. Identification of Freelancers and Consumers should be accurate and verified with a clear photograph. So Be You! Only verified users are allowed to use the services.
  2. Freelancers should always receive payment through GeeksPerHour.com. If a consumer offers to pay you outside the GeeksPerHour.com just diminish it and acknowledge the owner.
  3. Freelancers are divided into three levels; Level 1, Level 2, and top-rated. The rating of freelancers will depend on performance and the feedback received by the clients. If someone fails to perform up-to acceptation, may demote the ratings. GeeksPerHour.com has the right to change the ratings and levels. Initial rating will be based upon the skill tests.
  4. Contacting any Consumer outside the GeeksPerHour.com platform will be considered a legal offense. All the communication should be through GeeksPerHour.com site only. Strict action will be taken.
  5. All the agreements and disputes with the clients will be under the supervision of the owner (GeeksPerHour.com)
  6. The First payment will be released after 45 days of project completion.
  7. If an order is canceled (for any reason) the amount will be refunded to the client.
  8. Freelancers are responsible for paying any direct or indirect taxes, including any GST, VAT, or otherwise, which may apply to them depending on residency or location.
  9. Allotment of the project will be based on the ratings, skills, interests, and availability of the freelancers. After allotment of the project, freelancers cannot deny the accomplishment of the project. The initial ratings depend upon the GPH- Readiness Test.
  10. The Freelancers are expected to deliver the work on time with the proof of completion of services/projects on-page.
  11. The Services offered through GeeksPerHour.com must comply with our Terms of Service.
  12. The Freelancers will take a 70% share of the actual cost of the project rest 30% will be deducted by GeeksPerHour.com. or We primarily work on hourly rates with all our talent which is fixed immediately after the screening process. GeeksPerHour doesn’t charge any fees on it. Once you are connected to a client, you would be asked to fill in hours against the tasks completed which would be approved by the clients on a weekly basis. The payments would be made in the third week for the work done in a particular week.
  13. The charges for any test, registration and certification are non-refunding.
  14. There is no guarantee of projects and the owner will not be held responsible for the non-availability of work. The projects are assigned purely on skills, experience, communication, availability of the freelancers.
  15. To access the service Freelancers are required to pay INR 5000 as a security deposit.
  16. The payment of the trial package conversation will not be paid.
  17. If freelancers are found guilty of malpractices, like spamming, foul language, unprofessional behavior, lack of accountability will result in an account ban and the security deposit will be forfeited by the owner.
  18. Any misrepresentation of GeeksPerHour.com on social media platforms that could harm GeeksPerHour.com‘s reputation will result in legal action.
  19. Any account on GPH is not transferable
  20. If freelancers misrepresent the skills it may a cause lifelong ban on using the GeeksPerHour.com Site.
  21. Any Hacking or reverse engineering on GeeksPerHour.com website is not allowed. It may lead to the Cyber Security act.
  22. Freelancer grievance resolution should be used in case of any problems
  23. Freelancers are supposed to bill fair hours of deduction.
  24. There should be a detailed withdrawal of funds with proof. At a time minimum of $100 can we withdraw from freelancer wallet.
  25. If any freelancer(s) does any damage to Consumer(s)’s site, he solely is responsible for his/her actions and will bring himself into legal charges and have to restore/rebuild the website free of cost without demanding any extra sum of money.
